Vehicular Homicide Charges in Fatal Head-On Crash

Alcohol detected on Warren woman's breath following Bernards Township accident that killed Bridgewater man and injured his daughter, prosecutor says.

 

A Warren woman has been charged with vehicular homicide in a motor vehicle crash that killed a Bridgewater man in Bernards Township, according to Somerset County Prosecutor Geoffrey Soriano.

Lori Weiss, 44, was charged Thursday with second-degree vehicular homicide and third-degree assault by auto in the incident that occurred on Martinsville Road in Bernards Township Wednesday.

Bernards Township police add DWI, reckless driving charges on Friday.

Soriano said officers responding to the scene detected alcohol on Weiss' breath, and she was taken to the hospital with minor injuries.

According to Soriano, the crash occurred at about 8:45 p.m. Wednesday when Weiss's 2011 Mercedes Benz SUV crossed over the center line on Martinsville Road in Bernards Township and struck a 2008 Honda Accord head-on.

Soriano said Weiss failed to maintain her line while driving.

The Honda was driven by Peter Calvelli, 49, of Hodge Drive in Bridgewater. Calvelli was pronounced dead at the scene, Soriano said.

Calvelli's 25-year-old daughter was a passenger in the vehicle, and she was taken to Morristown Medical Center with serious injuries, Soriano said. Her condition was not immediately known Thursday afternoon.

The Somerset County Prosecutor's Office C.A.R. Team and the Bernards Township Traffic Safety Unit responded to the scene to investigate.

Soriano said the crash is still under investigation.

The law will perform. One tragedy here is the loss to a family that can never be undone. There is also the tragedy of a family that will be burdened by the action of one unthinking driver. The DUI drivers family will have to live through the fallout. Many get behind the wheel with no incident from their drinking. When does the potential for all the collateral damage to others prevent a drunk from driving? Many have parties serving alcohol to adults. Who checks to make sure who shouldnt be driving?

No mention of a DUI charge in this article. I've treated patients in similar circumstances that turned out to be diabetic (too much sugar in the blood produces breathe odor that I cannot discern as different from alcohol).

This is a horrible tragedy. Please pray for both families. For those of you assuming DUI, it does not say she was charged with any alcohol related offenses or that her blood alcohol level was above the limit. I do not know either of parties involved but I can see how angry people get when they hear DUI and just wanted to point out not to jump to conclusions. Finally, I don't think that's a mug shot of her. Probably her drivers license photo.

My sincerest condolences to the Calvelli family - I am literally at a loss for words after reading this. I had the opportunity to coach baseball with Peter and got to know him a bit. He was a great father and husband, and an all around nice person. While we can't lessen the impact of his loss, this wonderful family should know they have a very caring community that feels their loss and is here to support them.

Not sure if "detected on breath" means they BELIEVED they smelled alcohol (which is hardly cause to convict and post a mug shot or if that means they ran a breathylizer to detect the alcohol. If the former, I wish there would be a little more innocent until proven guilty.

No one is convicting the woman here - it's a discussion. Either you smell something or you don't. Do you believe you smell something? I'm not sure what that means. I've driven that road hundreds of times - it's not hard. I don't think it's jumping to a conclusion that between the officers smelling alcohol on her breath and her driving into a car in the opposite lane, to say it sounds like she very well may have been drunk. Maybe JM is right - she's a diabetic. I don't know. But if it walks like a duck...

I have been reading articles about this crash since it happened. I find it horrible to think what both these families are going through right now. Both have children!! Yes, drinking and driving is unacceptable especially today, when it's so easy to get a cab or someone to take you home. But, just because alcohol was on this woman's breath doesn't mean she was drunk. (although chances are it had something to do with the accident) For all the people who seem to think because she lives in Warren she is a spoiled rich b--ch that is ridiculous. The fact that she is from Warren and he was from Bridgewater has nothing to do with this tragedy. As human beings our emotions run crazy when someone is taken from us before their time. We should all hope these families get some help and get through this unbearable time in their lives.

Here's what we know. A man died. A woman was charged with vehicular homicide after alcohol was smelled on her breath. No announced DUI charges. The article written would lead readers to where that news leads them. In the meantime, many families are damaged and the tragedy will live in those families for the rest of their lives. This is a tragic event. It highlights the sensitivity to the fragility of life as well as the expectation of consideration when getting behind the wheel. It may seem responsible to some to drink and drive claiming they weren't legally drunk. But we all can have an opinion on that. Does drinking impair judgement? Ask those who are more in tune with this professionally. In the meantime, slurs against any involved, slurs of any kind aren't in order here. Drunk or sober, I wouldn't want to be responsible for the death of another. Let the courts do their thing. In the meantime, awareness of driving under the influence, or driving while over tired, or driving aggressively all lead to tragedies like this. My prayers go to all who are affected by this. Right now it is just a tragic event unfolding itself locally.

Jawce... there is no charge of DUI. There could be... but as Dan points out the facts are what they... nothing more. Was it alcohol? Texting? A deer? We do not know. You also know nothing about the driver, her life, family or her circumstances so you should not stand in judgement without all the facts. The report did not say she was drunk, did not say she was rich, did not say she was selfish. This is a tragic accident that has created unimaginable grief for many people. Let the facts come to light and allow the process to take place. I feel terribly for all of the families involved.

So sad for all the parties involved. Although the police detected a smell of alcohol on her breath did they administer a breathalyzer test to find out the blood alcohol level? Your article says she had minor injuries (only). I would guess that drinking prior to driving death and possible texting was the issue. We should raise the alcohol prices out of reach like the tobacco industry did and hopefully these idiots will think before the act.

Jawce - Once again it seems you are assuming she is rich, considering the towns both individuals came from it is quite possible that they shared a similar level of financial stability. So throwing out the words rich and bitch does absolutely nothing to assist in your argument, it makes you sound like a Middle School girl (which quite possibly you are). If you knew Mr. Calvelli or his family no one is saying that what happened isn't horrible, it is an absolute tragedy no one expects this sort of thing to happen fairly early in the night on a Wednesday. It really is quite easy to point fingers and make assumptions especially considering the article says officer Soriano "detected alcohol on Weiss' breath", but I can tell you this if I went to grab dinner and had one beer the smell of alcohol would be on my breath as well and I would not by any standard or legal means be considered drunk. I am sure people feel as passionate as you and don't post comments but at least they have the sensibility to not call someone a "DRUNK....spoiled rich biotch". Allow the legal system to play out, allow the reports to come in whether or not she was charged with a DUI or not and pray or grieve (your preference) for both families. It is a terrible, terrible tragedy for all involved. Regardless of the circumstances that surrounded the accident, no one should pass judgement on anyone without facts. Being mean and rude and judgmental is not going to change things and is not going to make it easier on what these families are going through. Everyone should just shut up and let the families deal with this tragedy. It is a very sad and unfortunate event. My heart goes out to all the children in these families, praying that the Calvelli daughter is ok, and for Mrs. Calvelli as well as Mr. & Mrs. Weiss.

Wasn't there another fatal accident on this stretch of road recently? Perhaps the speed limit should be lower, there needs to be a divider or more lights. DUIs or accidents can happen anywhere but it seems like that roadway may be particularly dangerous.

It can be argued that any road could be considered dangerous, it depends on the situation.

And why does thinking a road is potentially dangerous mean someone should grow up? My god. My 72 year old grandmother is terrified of driving down the mountain to get to my house even tough she's "driven that stretch hundreds of times with no incident." Does she need to grow up, too?

LC, I've driven over the GW Bridge hundreds of times without incident too, but I'm still glad there's a guard rail. I don't know what caused this crash or the other recent fatal crash, but I do know that people were killed there on more than one occasion. Comment has nothing to do with excusing the drivers, but with how to protect innocent people out on the roads. How many more people would have to die on that stretch of roadway before you'd think it was a good idea for a traffic expert to take a look at it?

the letter of the law aside. a tragedy has occurred. the driver of a car was killed, the other driver was driving the other car. no getting around that. let the law do or not do justice. i would not want to live with the knowledge that i drove a car in an accident where another left their family behind. righteous anger, justification of any behind the wheel alcohol, or just plain meanness has no place. the grief of the families involved gets minimized while the posturing of a few who need to promote their own intelligence or agenda overrides the sad facts of this incident. there is still a young lady in a hospital in serious condition. events like this can raise emotions. a pause might be in order to put aside personal emotion and consider those who are most immediately affected. this is my last comment. i have nothing to prove or achieve. this is just too too sad.

Law inforcement doesn`t need a breathlizer to get a conviction or even make the charge im sure blood was taken from this driver,with the chain of custody officer standing by while the blood was drawn at the hospital making the arrest charges from that result,which later will be used for the proscution or likely in this case a plea deal serving no jail time,depending on the lawyers the proscution and the judge....drivers history and her blood reading being under .20 at the time of the accident.... we`ll not even see a jury trial of her peers but a closed door session for final determination or the word conviction if your poor,im sure after tonight we`ll never here about this story again!

I never comment on things but as I read through these comments I knew I that to comment on this story. lt so sad that people who don't even know Lori are judging her based on her address and car that she drove. I know Lori. I don't know her really well but I can tell you that she has a heart of gold. She appreciates people and she has done so many good things to influence our world. I also know Lori...There is no doubt that she is a good mom and active in the community...we can demonize, we can speculate and we can even pass judgments even though we will never know until court day what really happened....sending her to prison although she is no threat to society is useless but necessary...she broke the law...i dont care what color her skin is...she broke the law...if we spent less time worrying about skin color we would be better off....lives of many have now been changed...lives of children are now altered forever.....there will be years of wrangling and settling....I pray for all....I too am a father of 2 and a baseball dad in the community....this is a tragic tragic loss and no matter what, we have laws, rules etc....let the state do its job...as far as her being released on bail...dont punish someone because they have means....they worked for it and that is to be commended...not ridiculed...her life is over.....her husband's as well....there is enough heartbreak on all sides to fill a mountain with

Skip - I think yours is one of the best comments here. I disagree on a couple of counts, though. Sending someone like this woman to jail is not necessarily useless. It sets an example for others as a deterrent. Also, even if she is a truly wonderful person (and she very well may be and just this one time made a really stupid decision), she should be punished for her actions.(Which I know you said, too.) I also disagree that her and her husband's lives are over. They are changed, for sure. Only the deceased man's life is over. She will be able to see her children grow up, marry, etc.

Let us all use this as another reminder to never drink and drive. My kids are in their 20's and I always told them I'd pick them up from wherever they were and whatever time it was with no questions asked. The possible consequences are just not worth the risk.

The reality is that woman will plead to 5 years, go to Edna Mahan prison, which is more than a country club than a prison, it even has plasma tv's, and she'll be out in 3, and this will all be forgotten. She'll get back in the Mercedes and probably drink more next time.

Peter Calvelli will get justice. The Calvelli's aren't going to take the 100k insurance money on the mercedes less the 33% lawyer fee and release their claim again the Weiss family for only 77k. The husband Mitchell S. Weiss, has tens of millions of dollars, and the Calvelli's will take both Lori & Mitchell to court, and will absolutely not take the 100k in insurance money. Also, they will find out if Lori was served at a bar, and sue the bar as well. Justice will be served.

First of all, I'd bet that the auto policy is much more 100K. You don't live in an expensive house, drive a Mercedes and insure yourself for 100k. They probably have 500k/250k and an umbrella policy to deal with an excess claims.

The onboard computers on her SUV are quite advanced. They not only record the vehicles speed and braking patterns, they record the drivers motion and balance during operation. The wheel sensors can reveal things that the naked eye cannot see. If equipped, the onboard cameras also record forward and backward the whole time the vehicle is moving. From the time she started the vehicle until impact, the vehicle has an active record.

there is enough hate on this site to make me wonder if i've delivered myself and my family into a community of small minds. it's amazing what people will put in writing hiding behind screen names. if this is acceptable behavior in a social setting, it isn't the social settings i attend. i think the spreading of ones own misery is their own personal definition. to harm both families with this unfettered poisonous rhetoric is a sure sign of small minds.

As a passenger in a car driven by my son with 2 grandchildren at around 8:30 - 8:40 pm entering Briarwood drive on the same evening coming from 525 north we were almost hit head on by this woman and same car-we stopped while the car was less than 20 feet in front of us before she swerved to her right at a high speed and almost rolled her SUV.
I screamed thinking we were going to be hit head on and I would lose my son and grand-children. We are very very lucky and blessed by God that we were not the ones who were hit that night. But my heart is breaking for her, and the other family. I haven't slept since this night. It was terrifying. We were so so lucky and were just minutes from the road she hit Mr. Cavelli on. Pray for everyone.

My most heartfelt condolences. The vehicle was registered in the husband's name, Mitchell Weiss, a former Goldman Sachs lawyer who owns 26 companies. I would recommend that the family retain a lawyer to sue this family. The lawyer will want you to take the insurance money on the mercedes, however, that would be a mistake, as you would release your claim for the tens of millions you could recover from the family. Get a local personal injury lawyer to file a lawsuit, and don't let the lawyer convince you to take the tiny insurance money, but make sure you hold the family responsible. They won't declare bankruptcy, as they have too many companies, and too much money. The son and daughter should have their college and graduate school paid for, as they shouldn't have to be waiters to earn the money after their father so unjustly taken from them. Rest in peace Peter Calvelli.

My sincere condolences to all.... victim, victim family, criminal, criminal family

However, my belief is that regardless of "circumstances" there are some crimes or consequences of actions that you do not get a 2nd chance from...... taking the life of an innocent person is one of these actions

We now know more.... This was a DWI, open container in car, before 9pm at night, driving a newish SUV on a local road we all travel, privilidged background.... with the very worst consequences possible.... and affecting innocent people with no opportunity to recover......call me an unfeeling azzzz, who has made plenty of mistakes, but offender should never see the light of day, and she should not go to min security white collar prison

I agree that if guilty, the severest possible form of punishment is in order. But what does the time of day and "newish SUV" have to do with it? As far as type if prison, the authorities most likely will not place Lori Weiss with violent offenders.

Would you not agree that SUV drivers are like the old Volvo crowd? probably the worst drivers on the road

I did not say with violent offenders, but she should not have any comforts or freedoms... she took a life by acting irresponsible and that life is not coming back

Time of day is an indicator of someone more likely to have a drinking problem; someone that drunk and out of control relatively early is usually someone that drinks a lot and alone.

Hi T,
I don't know about the SUV drivers being the worst. I think there are just so many on the road, especially right here in Warren. I see plenty of other cars with nut bars behind the wheel.
I agree with you about no comforts or freedoms. And truly, a message needs to be sent that such actions are not tolerated by our legal system.
That's an interesting point about the time of day. I would have thought more about it had the tragedy occurred in the morning or middle of the afternoon, though. She could have been out to dinner with friends. I guess only the police and attorneys know where she was prior to getting behind the wheel.
The whole thing is just sad beyond words. My heart goes out to the Calvelli family and Lori Weiss's children.

Just about all of us have done this: Gone to dinner with friends, had a glass of wine, maybe two. Then drove home, without thinking much about it. I think we should all think about it. I think we should think about Mr. Calvelli. His daugher Rachel. His family and friends that have to live the rest of their lives without, their husband, father, uncle, relative or friend. Think about handing over the keys, calling a cab, or ordering a glass of water instead. I know I will.
